2) Payment
AVO Turboworld accepts the following methods of Payment:
Credit Cards: Visa Card, MasterCard, American Express, and Discover. All overseas shipments over a certain amount must be paid via Bank Telegraphic Transfer.
3) Prices
All prices are subject to change without prior
notice. Prices do not include tax. Orders placed within Washington State will be charged local State taxes at checkout. Overseas Shipments and Wholesale orders are not charged tax unless required by law. All prices exclude freight and insurance charges, which are charged at checkout.
4) Ordering
Orders submitted for overseas delivery are shipped as per
client instructions. We mainly ship via UPS, but competitive rates are available for DHL,
FedEx, USPS, and Sea and economy air freight upon request.
AVO Turboworld will not insure shipments unless requested
in writing. The customer assumes all responsibility
for freight charges. All orders will not be released for shipping
under any circumstances, until such time as payment is received
in full. During the normal course of business products may
be available only in limited quantities, or may become unavailable,
due to situations AVO Turboworld has no control over. Accordingly
we cannot always guarantee the timely availability of the
product. In the event of this happening, the AVO sales and
dispatch team apologies for any inconvenience caused.
4) Shipping
All parts become the responsibility of the customer on removal
or dispatch from AVO Turboworld LLC or Authorised agent.
This includes problems with shipping that are beyond the control
of AVO Turboworld LLC or Authorised agent.
5) Return of Goods
All goods returned will be subject to a 15% restocking fee,
with the exception of faulty parts accepted for warranty.
For a full description of AVO Turboworld LLC warranty
policy refer to our Warranty policy statement. Parts that have already been fitted to a vehicle will not be accepted back unless for warranty reasons. Only un-used,
un-damaged and complete parts will be accepted for return,
with the exception of special order or custom made parts.
These items will not be accepted for return. Any claim for
return must be done within 30 days of purchase. No parts will
be accepted for return after this date. Any returns will not
be accepted for credit unless accompanied by a sales invoice.
6) High Performance Parts
Any high performance part produced by or sold by AVO Turboworld
LLC or authorised agent may not be proven emissions legal
and are as such for off-road use only. In such cases where
AVO Turboworld LLC or Authorised agent supplies high performance
parts for customer fitting, the purchaser assumes all responsibility
for installation or these parts; any and all of the potential
risks involved, and accepts full risk from their usage. Certification
by an Engineer / EPA / CARB approval for a vehicle fitted
with such high performance parts may be required to satisfy
local road laws. The purchaser of such high performance parts
shall be responsible for any such Engineers / EPA / CARB certification
at their expense. AVO Turboworld LLC or Authorised agent
cannot be held responsible for incidental and consequential
damages, property damage, or personal injury damage in excess
of that permitted by Law.
7) Replacement Performance parts
It is AVO Turboworld LLC’s policy that it does not sell
AVO Manufactured Turbocharger / Turbosystem parts as individual
items. AVO Turboworld LLC will only sell complete Turbocharger
or Turbosystem assemblies to ensure both the quality of the
finished item and its design integrity. AVO Turboworld LLC’s
policy towards only selling the complete assembly does not
mean that any owner of genuine AVO Turboworld Turbochargers
or Turbosystem’s will ever be refused the sale of individual
replacement parts. AVO Turboworld LLC requires that the
purchaser provides some form of proof of ownership in order
to qualify for the sale of replacement parts. This can be
in the form of either a purchase receipt or the return of
the original piece requiring replacement to either AVO Turboworld
LLC or an Authorised agent at the owner’s expense.
8) Property and Payment of Parts
(a) Property in any parts supplied by AVO Turboworld LLC
or by Authorised agent shall not pass until such time as payment
has been made, provided that full risk in the parts shall
pass from the purchaser and the purchaser shall carry the
loss arising from the damage caused by AVO Turboworld LLC’s
parts, however it should be caused, from the express time
that possession passed from AVO Turboworld LLC or Authorised
agent.
(b) The purchaser shall hold the parts as bailer the keep the parts separate from the parts within control
of the purchaser and not owned by AVO Turboworld LLC or
Authorised agent. They should also be properly stored, protected
and insured.
(c) Without abrogating from any of the above, the purchaser
has the right to resell the parts in the ordinary course of
business, provided that such sales shall not give rise to
obligation to AVO Turboworld LLC or Authorised agent, or
detract in any way from the fiduciary duty.
(d) In the event of non-payment as provided for in the contract
of sale, or if an application for the winding up of the purchaser
is made, placing into liquidation or official management or
an agent in possessions appointed(or some other form of insolvency
administration is commenced) prior to full payment of supplied,
AVO Turboworld LLC, or Authorised agent is irrevocably authorised
to enter the purchasers premises and remove any parts (including
those from an engine or vehicle to which they may be installed
or fitted) which are owned by AVO Turboworld LLC or Authorised
agent. The purchaser shall be liable for all costs incurred
by AVO Turboworld LLC or Authorised agent in exercising
this right of retrieval, including all legal costs on a client
solicitor basis. AVO Turboworld LLC or Authorised agent
shall not be liable for any loss or damage caused by the company
exercising this right of retrieval. Further, on the happening
of any event described in this clause (d) the right of the
purchaser to resell the parts as provided for in clause (c)
is terminated and the purchaser is required forthwith to return
the parts |
